Welcome to FundooMath! These Terms of Service ("Terms") govern your use of the FundooMath mobile application and website (collectively, the "Service"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using FundooMath, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. Eligibility and Account Registration

2.1 Age Requirements

  • FundooMath is intended for use by children ages 6-8 under parental supervision
  • You must be at least 18 years old to create an account
  • By creating an account, you represent that you are the parent or legal guardian of any child profiles you create

2.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

3. Subscription and Payment

3.1 Subscription Plans

FundooMath offers the following subscription options:

  • Free Trial: 7-day trial with limited features
  • Monthly Subscription: $9.99 per month, auto-renewing
  • Annual Subscription: $99.99 per year, auto-renewing

3.2 Payment Terms

  • Payment is processed through Apple App Store or Google Play Store
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices are subject to change with 30 days notice
  • All fees are non-refundable except as required by law (see Refund Policy)

3.3 Free Trial

  • New users receive a 7-day free trial
  • Credit card required (no charge during trial period)
  • Cancel anytime during trial to avoid charges
  • Automatically converts to paid subscription after trial
  • One free trial per household

3.4 Cancellation

  • Cancel anytime through your App Store or Google Play account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused time
  • Access continues until the end of the paid period

4. License and Use Restrictions

4.1 License Grant

We grant you a limited, non-exclusive, non-transferable license to:

  • Download and use the app on authorized devices
  • Access the Service for personal, non-commercial use
  • Create child profiles for your children or children under your guardianship

4.2 Restrictions

You agree NOT to:

  • Copy, modify, or create derivative works of the app
  • Reverse engineer, decompile, or disassemble the app
  • Rent, lease, sell, or sublicense the Service
  • Use the Service for any illegal or unauthorized purpose
  • Share your account credentials with others
  • Circumvent any security or access control mechanisms
  • Upload malicious code or attempt to harm the Service
  • Scrape, crawl, or extract data from the Service

5. User Content and Data

5.1 Your Data

  • You retain ownership of your personal information and child progress data
  • We collect and use data as described in our Privacy Policy
  • You grant us a license to use data to provide and improve the Service

5.2 Feedback

  • Feedback and suggestions you provide become our property
  • We may use feedback without compensation or attribution

6. Intellectual Property

6.1 Our Property

All content, features, and functionality are owned by FundooMath, including:

  • App design, text, graphics, logos, and icons
  • Educational content and curriculum
  • Software, algorithms, and source code
  • Trademarks, service marks, and trade names

6.2 Copyright

All materials are protected by copyright, trademark, and other intellectual property laws. Unauthorized use is prohibited.

7. Educational Disclaimer

  • FundooMath is a supplemental learning tool, not a replacement for formal education
  • We do not guarantee specific learning outcomes or academic improvements
  • Results may vary based on individual child's abilities and effort
  • Parents should supervise and supplement app usage as appropriate

8. Service Availability

8.1 Availability

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service
  • Service may be unavailable due to maintenance, updates, or technical issues
  • We will provide advance notice of scheduled maintenance when possible

8.2 Updates and Changes

  • We may update, modify, or discontinue features at any time
  • Major changes will be communicated to users
  • Updates may be required for continued use

9. Termination

9.1 By You

  • Cancel subscription anytime through your app store account
  • Delete your account by contacting support@fundoomath.com

9.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse or misuse the Service
  • Fail to pay subscription fees

9.3 Effect of Termination

  • License to use the Service terminates immediately
  • Account data may be deleted after termination
  • Some provisions of these Terms survive termination

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

  • Merchantability and fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security of data transmission

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid in the last 12 months
  • We are not responsible for third-party services or content
  • Some jurisdictions do not allow limitations on warranties or liability, so these may not apply to you

12. Indemnification

You agree to indemnify and hold harmless FundooMath, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, contact us at support@fundoomath.com to resolve disputes informally.

13.2 Arbitration

  • Disputes will be resolved through binding arbitration, not court
  • Arbitration is conducted by a neutral arbitrator
  • Each party pays their own costs unless otherwise awarded
  • Small claims court is available for qualifying claims

13.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

14. Governing Law

  • These Terms are governed by the laws of the United States
  • Jurisdiction and venue shall be in the applicable state courts
  • No choice of law rules apply

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FundooMath.

15.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in effect.

15.3 Waiver

Failure to enforce any right does not waive that right.

15.4 Assignment

You may not assign these Terms. We may assign our rights and obligations to any party.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

16. Changes to Terms

We may modify these Terms at any time:

  • Changes will be posted on this page with an updated date
  • Significant changes will be notified via email or in-app notification
  • Continued use after changes constitutes acceptance
  • If you don't agree, discontinue use and cancel your subscription

18.1 Apple App Store

  • These Terms are between you and FundooMath, not Apple
  • Apple is not responsible for the Service or content
  • Apple has no obligation to provide support
  • You must comply with Apple's Terms of Service

18.2 Google Play Store

  • These Terms are between you and FundooMath, not Google
  • Google is not responsible for the Service or content
  • You must comply with Google Play Terms of Service

By using FundooMath, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
